New amendments to the Labor Code

On 3 February 2012 was enforced the Law no.79/2012 which is amending several Moldovan legal acts. The above-mentioned law is amending legislation in the labor law field (The Law on Remuneration no.847/2002 and the Labor Code from 2003).

 

As per the modifications of the Labor Code of 2003 we can emphasize the following ones:

 

-          art.9(2)(c) is providing the new obligation of the employee to always have upon himself/herself the permit that gives him/her access to the working place (besides his/her obligation to respect the internal regulations – which is still kept in the amended version of this legal provision);

 

-          art.10(2)(c) is providing the new obligation of the employer to approve in the first month of the year the employee list (and their positions) and to submit this list to the local labor inspectorate (while the old provision was only saying that the employer had to approve it yearly);

 

-          art.10(2)(d) is providing the new obligation of the employer to give to the employees a permit that gives him/her access to the working place (besides the employer’s obligation to provide to employees the labor as provided in the contract);

 

-          art.136(5) is providing that the salary for the 1st category of employees at the level of company or branch (field of production) will be renegotiated according to the economic situation of the company or branch and, at the same time, the salary of an employee will never be under the minimum established by the Government (while the old provision would only mention about the salary will be reexamined yearly);

 

-          art.155(2) is providing that the salary (and other retributions) for the employees working in at least two places (cumul) will be set in the collective labor convention but in any case it will not be smaller that the salary of an employee from the same company;

 

-          other provisions having to do with the security at the working place.
